More contract talk...HOW TO MAKE ONEOk I have talked and read some people's TOS and frankly they freak me out.... So I thought I needed a GENERAL talk about documents and how to set them up.______________________________________________________Terms of Service: This document is where you lay out YOUR rights and the PATRONS rights to the product you are delivering. This is Mine. Mine only applies to custom adoptions. If you are doing commissions you need a different one because you often don't own the characters. So here is what you ROUGHLY need to address in a TOS1. At what point does the work become theirs? Why? I have this so up till the moment I upload it. I own it.2.What the patron do/not do with the design? Why? so they don't do something with it you don't like3.COMMERCIAL AND PRIVATE USEyou have to do this. no exceptions. who owns what.4. Anything else you want to talk about? Other sectionMyo-
Okay, Serious Money/Terms TalkIt is time we had a serious talk about money watchers. If you sell PLEASE take a moment to read this so you don't get colossally fucked over. YOU NEED A CONTRACT IF YOU SELL.YOU NEED TERMS AND SERVICE AGREEMENTS.YOU NEED TO KEEP EVERYTHING.If you sell and you do not keep your notes organized, do not have contracts, do not have agreements. You are going to get fucked over (unless your incredibly experienced and can smell fraud from a mile away). I say this over and over and over and people tell me they don't want to be too "serious" or they don't know what to say. It is your responsibility as a business owner to keep track of everything. Not just because it is good business but so when someone tries to rip you off after work is delivered by asking for a refund from their financial institution you can go. "no I have paperwork, their real name, and their signature" and send them a nice

How to Pay artists using PaypalI'm still getting payments for digital artwork that require shipping because people forget to click the 'no shipping required' box. I can have my account flagged if I don't ship items that apparently need to be shipped. Please be sure to take care when ordering digital commissions from artists! Here is a super cool Tumblr post that shows you how to do the right thing when ordering digi-commissions. I'll be using this helpful post when people order my commissions so people have a visual ref. C:http://shrineheart.tumblr.com/howdoIpayyouEDIT: Paypal recently revamped their site so everything is set up differently (I kinda liked how it was set up before) Here's how the 'goods and services' page should look: http://fc08.deviantart.net/fs70/f/2014/185/8/d/image_by_araktugage-d7p8w6w.jpgSee how the address says it's optional? It's best not to choose any address when sending a payment for a digital commission(s) unless there's something that do

selling advice (BUT IT WONT SELL!) (please read)"They barely sell as it is, I am afraid if I raise prices anymore they won't sell at all""My art isn't worth it""People won't pay what I want""Insert a million excuses here"This is you! Or rather I should start off by saying this is all of us because I don't believe in playing the victim, we are equals here. We have all said it at some point in regards to sales. I personally have said it plenty of times. You, the reader are probably no exception.Pricing is difficult, I offer my service and advice to who I can but at the end of the day I can't reach everyone to give you this talk. So I am writing this general journal about why your art ACTUALLY does not sell. I am going to try to be possitive but this journal may be harder to digest then most of the other informational journals simply because of the nature of the reason under pricing occurs. Which is because the seller has no self confidence, no experience, and is making business about their worth as
To all artists sellingIn the last few months I have been really successful with my customs. I have loved every second of doing commissions and am by no means burned out but its because I have set my prices, time, work, and paperwork for it to be that way. So, to all people selling their work/customs/adopts...w/e I would like to invite all of you to use and abuse all of my contacts/terms of service/ pricing forums. I am updating the format soon so be on the look out ....but I have spent a lot of time on DA. I have done a lot of commissions, my friends have done a lot. I see people struggle every day and I can only help so many because typing all this can take over 12 hours.... xDSo USE AND ABUSE mine and others!Mine are on my profilealso checkVholkrum- Pri
Not a Rant, Motivational (plz read)Things have been hard....I read it a lot. I read it all over my messages, my messengers, everywhere there are messages of "things have been hard". I did a experiment with myself over the last few months. I didn't talk about the "things" that were hard in my life unless I absolutely had to or to vent a little about short frustrating incidents. I am a blabber mouth for those who don't know me too well. Frank and honest to a fault. If something goes wrong I am typically the first in the room to go"Oh well, shit happens! F this, F that." It has been difficult not to say every day "things have been hard." I did cave and say it once and a while but not as much as it would have pleased myself to say it. Before I start anymore. Read this as positively as possible. I am not making complaints, I have achieved my freedom.I have been fighting my own "things" since 2007. I suppose really what it is, is that when dealing with difficulty it is just grief. Grief that it just won't stop. I went
Cornwall / Art Raffle!A spontaneous decision to go and book off 5 of my holidays will lead to a slight change of the deadline of the raffle. I will now announce the winner on the 28th June instead of the 22nd, since I will be in Cornwall over that time. Sorry! Are some of you guys living here? It would be cool to maybe see some of you outside of the internet. I will be going with two of my friends and we'll probably stay in a Youth Hostel, if couch surfing won't work out, haha. We'll most likely arrive via train at the Penzance rail station on Monday evening, from where we will try to find a cheap place to stay. Trains are hella expensive :II cannot wait to finally see Englands seaside! It was about damn timexD----------- Some weeks ago a close friend of mine did this and it seemed like a lot of fun,
A Beginner's Guide to Offering Commissions OnlineI decided to write this journal because in the last month alone, I had about five young artists ask me this question in one form or another: "How should I go about offering commissions?" This seemingly easy question can actually be quite difficult to answer. The first time I was asked this question, I expected to write only a paragraph response. I was shocked to find that once I had finished writing my response, I had been writing for almost a half hour and had written five paragraphs. Why is this not a simple question? I think the answer lies in the fact that how to offer commissions is not altogether intuitive. I know that when I began to offer commissions, I was at a complete loss. It took me a few years before I got into the swing of things. Even now I make mistakes. So, without further ado I present a beginner's guide, built on my many mistakes, many accomplishments, and 5 years of experience! One of the first things I recommend
How to Protect your digital sales v.1.2[Updated]V.1.2 - #9 rule Added on - 8/1/2014---Due to recent drama caused by ToxicMutagen/Pixlett, I'm making this handy-dandy guide for newbie salesmen who wish to protect their interests.Hi! Are you an aspiring digital artist? Do you want to sell your creations? Never a better time than now! However, there are people out there who will lie and decieve you for your hard-earned cash and it could ruin you if you are not smart about protecting your own assests! Here's some tips for you fellow digital art sellers out there:1) CREATE A TERMS OF SERVICE.*Your ToS should probably include something about the things you will and won't draw, the right to refuse service at anytime, information of how to properly place and cancel an order, and any repercussions that will happen by not abiding by this agreement.2) HAVE THE BUYER E-SIGN A WRITTEN CONTRACT STATING THEY AGREE WITH YOUR TERMS OF SERVICE* AND AGREE TO PAY THE AGREED UPON PRICE. DO NOT TAKE A PA
Helpfull Selling Mindset (another plz rd)I got a note this morning from someone asking for my assistance and advice about sales. They are having a reselling issue and were inquiring about TOS/contracts. But from what they wrote I could tell that information wouldn't help them with the core issue. I have left out their initial note and kept them anonymous but I thought some of you might get something from my reply regardless.______________________________________________________________________________ It is really lovely to hear that you have had such a wonderful experience selling up till now! Do not let this recent change discourage you. This is not a personal situation/attack that you are going through so do not let it impact you on a personal and emotional level. I know it is painful. I have had it happen and it really does hurt. It is very easy to flip a switch your mind and say "never again" after it happens. It is easy to respond to it by throwing rules and regulations at your work or respond by making co
Why advertising ain't evilOne of the things I mentioned in my journal about social interaction was that you should only watch a person on DeviantArt when you were genuinely interested. While that states the obvious, the statement sort of backlashed on me, and many people called me a hypocrite for saying the above thing, because I've been advertising my profile at dAhub and apparently that's one of those things you shouldn't do.However, I wouldn't be me if I didn't think of this as bullshit.I've been calling this whole "marketing is evil" statement on DA utter nonsense before, and I will do it again. Because it actually is. It makes completely no sense to be on a website with so many artists that want to sell their art/commissions/adoptables for a reasonable price. Yet when anyone doe
things i lermed for how to do art-sketch when u feel a burning flame in your heart.-keep a list of things u want to draw for when the flames are burnin but the brain's not churnin-don't try to draw if u feel empty and sad, go outside and flail ur legs back and forth instead, write off entire weeks for exercise and doing real life instead of art if you gotta, it's not something u'll forget how do so don't stress-you can draw anytime even in the morning if you want to -especially try to do the good lineart on the faces and eyes early in the day before the coffee kicks in-don't start with the eyes don't start with the eyes DON'T start with the eyes start with the hair to warm up your pencil THEN do the eyes-pray/dance/meditate before u pencil the eyes-don't erase it, just transform tool on the computer-what is traditional media? its where you lower your standards and try to calm down, good luck with patience-back up BACK UP hold ur paper far away from your face and unfold that pretzel of a spine to check on
